Theft of Services

Theft of services (Alabama Code 13A-8-10) occurs when:

  • A person intentionally obtains services known by him to be available only for compensation by deception, threat, false token or other means to avoid payment for the services
  • Having control over the disposition of services of others to which he is not entitled, he knowingly diverts those services to his own benefit or to the benefit of another not entitled thereto.
  • "Services" includes but is not limited to labor, professional services, transportation, telephone or other public services, accommodation in motels, hotels, restaurants or elsewhere, admission to exhibitions, computer services and the supplying of equipment for use.

Theft of services in the first degree (Alabama Code 13A-8-10.1):

  • The theft of services which exceeds two thousand five hundred dollars ($2,500) in value.
  • Theft of services in the first degree is a Class B felony.

Theft of services in the second degree (Alabama Code 13A-8-10.2):

  • The theft of services between one thousand five hundred dollars ($1,500) in value and two thousand five hundred dollars ($2,500) in value.
  • Theft of services in the second degree is a Class C felony.

Theft of services in the third degree (Alabama Code 13A-8-10.25):

  • The theft of services which exceeds five hundred dollars ($500) in value but does not exceed one thousand four hundred and ninety-nine dollars ($1,499) in value.
  • Theft of services in the third degree is a Class D felony.

Theft of services in the fourth degree (Alabama Code 13A-8-10.3):

  • The theft of services which does not exceed five hundred dollars ($500) in value.
  • Theft of services in the fourth degree is a Class A misdemeanor.
