Kidnapping (1st Degree) (2nd Degree)

Under Alabama Code 13A-6-43, the charge of Kidnapping is a very serious offense with a lengthly prison term and heavy fines if convicted. A person commits the crime of kidnapping in the first degree if he abducts another person with into to 1) hold her for ransom 2) use her as a shield or hostage 3) accomplish or aid in the commission of any felony or flight therefrom 4) inflect physical injury upon her, or violate or abuse her sexually 5) terrorize her or a third person or 6) interfere with the performance of any governmental or political function.

Importantly, a person does not commit the crime of kidnapping in the first degree if he voluntarily releases the victim alive, and not suffering from serious physical injury prior to apprehension.

Kidnapping in the First Degree is a Class A felony offense.

A person is guilty of Kidnapping 2nd Degree, under Alabama Code 13A-6-44 if he abducts another person. Kidnapping in the 2nd Degree is a Class B felony offense.
