Theft of lost property (Alabama Code 13A-8-6) occurs when:
- A person actively obtains control over the property of another which he knows to have been lost or mislaid.
- To have been delivered under a mistake as to the identity of the recipient or as to the nature or the amount of the property.
- With intent to deprive the owner permanently of it, he fails to take reasonable measures to discover and notify the owner.
Theft of lost property in the first degree (Alabama Code 12A-8-7):
- The theft of lost property which exceeds two thousand five hundred dollars ($2,500) in value.
- Theft of lost property in the first degree is a Class B felony.
Theft of lost property in the second degree (Alabama Code 13A-8-8):
- The theft of lost property between one thousand five hundred dollars ($1,500) in value and two thousand five hundred dollars ($2,500) in value.
- Theft of lost property in the second degree is a Class C felony.
Theft of lost property in the third degree (Alabama Code 13A-8-8.1):
- The theft of lost property which exceeds five hundred dollars ($500) in value but does not exceed one thousand four hundred and ninety-nine dollars ($1,499) in value.
- Theft of lost property in the third degree is a Class D felony.
Theft of lost property in the fourth degree (Alabama Code 13A-8-9):
- The theft of lost property which does not exceed five hundred dollars ($500) in value.
- Theft of lost property in the fourth degree is a Class A misdemeanor.
